Disclaimer and rental terms for Homes for the Moment…

Homes for the Moment… makes an honest and diligent effort to acquire accurate information. However, errors can occur. Therefore, Homes for the Moment does not guarantee the accuracy of any information available on our website, and is not responsible for any omissions, errors or misrepresentations. This website is intended to provide users with general information on matters that they find to be of interest. Availability features and floor plans are subject to change without prior notice. Price ranges may vary with the season and change without notice.

All our homes are on a first request basis and subject to approval. First paid, first served. For security and privacy reasons, addresses are never given out until we confirm your reservation. These properties are privately owned and Management reserves the right to refuse service to anyone.

1. To reserve a home more than 2 months prior to your arrival date, call or email us. Once you have selected your home and checked availability, you will need to make a rental down payment by wire transfer of 50% of the rental amount due for your period of stay to guarantee your reservation. Upon receipt of your funds, you will receive an email from us acknowledging your down payment and confirming your reservation.  At least 2 months prior to your arrival, the balance of the rent plus a refundable security deposit and cleaning fee is due. Upon receipt of the full rent and security deposit, We will email you a contract. You must sign the contract and return it to us signed via Fax or Email within 3 days. We will then email you directions to your rental home, nearby points of interest, stores, restaurants and shopping information.

2. To reserve a home less than 2 months prior to your arrival date, call or email us. Once you have selected your home and checked availability, you will need to pay by wire transfer or cashier check for 100% of the rent covering your entire stay plus a refundable security deposit and cleaning fees if applicable. Upon receipt of your funds, you will receive an email from us acknowledging your full payment and confirming your reservation. Shortly after your payment has cleared, we will email a contract which you must sign and return to us via Fax or Email within 3 days. Upon receipt of your signed contract, we will email you directions to your rental home, nearby points of interest, stores, restaurants and shopping information.

3. Arrival and Departure times: Check in time is between 3 pm and 6 pm for arrival.  If you cannot arrive by 6 pm due to a late flight schedule or any other unforeseen circumstances, we can make special arrangements. However, due to over time staff fees which we have to comply with, we inform you that any arrivals after 6 pm and/or any time of the day on Sundays and Holidays requiring the presence of Homes for the Moment will be charged an extra fee up to $100. Check out time is 11 am at the latest. Any stay past each hour will be accounted a full hour. Late departures will be charged a late fee per hour up to $100 per hour.  Departures before 9 am and /or any time of the day on Sundays and Holidays requesting the presence of Homes for the Moment staff will be charged an extra fee. Early arrivals can be arranged if possible but will be charged an hour fee up to $100 an hour for checking in before 3 PM.

4. Personal amenities: All our homes include linen and towels and a minimal supply of toilet tissue, paper towels and cleaning products. Once these supplies have been depleted, you will need to provide your own.

5. Phone, Internet, Cables, Satellite TV: Most of our homes have a telephone offering local access only. However, some homes may not be equipped with a telephone. We are aware how important a telephone is to you and we recommend that you bring with you your own cell phone or your long distance calling card. Our homes are all equipped with DSL Internet access and or wireless. In the event, the rental property you rent does not give you proper access to Internet and/or satellite/cables, we shall not be liable or responsible for 3rd party companies and/or servers down during your stay.

6. Smoking: We do not allow smoking inside the property. Certain properties do not even allow smoking  outside. A front door sign and/or a brochure will instruct you whether the rental property is a smoking or non smoking property. So, if you must smoke and only if the property allows outdoors reserved areas for smoking, please note, that it is forbidden to throw cigarette butts on the premises due to fire hazard in California. If you do not respect the smoking rules and cigarettes buds are found on the property, then this will result with no refund and complete forfeiture of your security deposit.

7. Pets: are allowed upon written approval only. Undisclosed pets will cause full forfeiture of your security deposit.

8. Utilities: In most circumstances, all utilities are included in the rental price but some of our homes may not include all utilities such as usage for Air conditioning and gas for heating. Gas fees will be charged for properties offering heated pool and/or spa. However, we may apply all or part of utilities usage costs for some of our homes.  Electricity, Gas and Water will be charged for rentals over one (1) month. If applicable, any amount(s) due for gas and/or electricity shall be subtracted from your security deposit. Pool heating is additional to the rent due and may varies from $175 to $500 per week.

9. Special Events: Large parties, weddings and commercial filming and photo shoot of any kind are strictly forbidden without written approval by Homes for the Moment. Failure to obtain approval will cause immediate eviction and a full forfeiture of your security deposit plus any additional expenses caused by utilities usage and/or damages (if any).

10. Security Deposit: is requested for any unforeseen damages, missing items or property belongings, unreasonable cleaning or unpaid fees. In addition to the cash Security Deposit, we request to have a credit card on file which is not charged unless the damages are made to the property and/or its belongings in excess of the cash Security Deposit.  Damages requiring professional repairs may delay timely refunds and additional maintenance fees may apply. Any rentals for two weeks or less require a minimum refundable security deposit equal to one (1) week’s rent. Any rentals for more than two weeks require a minimum refundable security deposit equal to two (2) weeks’ rent. Any rentals for 2 months or more require a refundable security deposit equal to two (2) months rent. Higher security deposit may be required for pets or special events.

11. Cleaning Fee: All our homes are professionally cleaned prior to your arrival and upon your departure. After departure, a departure cleaning fee from $150 to $800 will be either paid in advance or subtracted from your security deposit. The departure cleaning fee is for a normal departure reasonable cleaning; however, if extra unreasonable cleaning is required due to the property (inside and/or outside) not being left in satisfactory condition, then an extra amount will be deducted from your security deposit. 

12. Taxes: The tax average of 10% to 14% in addition to the rental price. Occupancy taxes are administered at the local level and are subject to change by municipal government.

13. Parking: If applicable to the property: $500.00 fee will be charged per lost or missing parking pass.

14. Cancellation: If you cancel 90 days or more prior to your reserved dates and after you have already paid the rental down payment, we will refund your money less an administration fee up to $200 only if we are able to re-rent the property for the same time period within 30 days after we received notice of your cancellation. Security deposits will be refunded minus banking fees and less an accounting fee up to $100. If you cancel between 61 days and 89 days prior to your arrival dates, this will result in loosing reservation and 50% of rental fee plus bank charges and administration fee up to $200. Any cancellation made 60 days or less prior to arrival dates will result in loosing reservation and 100% of rental fee plus bank and administration charges. Security Deposit will be refunded minus banking fees and less accounting fees.

15. Payment: We do not accept credit cards, but you can pay by Bank Wire transfers, US cashiers checks or California local checks. Any check returned unpaid by the bank (stop payment or NSF) will result in a NSF charge of 3 times the amount of the written check with a minimum fee of $150.00.

16. Maintenance:  will be available ONLY for major vital maintenance and living repairs emergencies of the rental premises not due to renter's misuse, waste or neglect or that of his employee, family, friend, agent or visitor. Homes for the Moment cannot guaranty that minor maintenance not considered as an emergency will be performed during your stay. Maintenance calls are only available during business hours and not available on Saturdays, Sundays and/or holidays. Note, that maintenance is handled by Home Owners and subject to their approvals. In the event, maintenance and/or repairs are requested during your stay, Homes for the Moment can only dispatch calls to Owners to obtain their approvals and have no other remedies over any lack of maintenance performance and/or negligence from owners on any properties listed on our website. Therefore by renting any properties from this website and/or Homes for the Moment, you shall wave any and all responsibilities and/or liabilities towards Homes for the Moment, its staff and its owners..

17. Terms and Conditions: These properties are rented with the understanding that you will leave them at checkout in the exact same condition as when you checked in. Prices may vary according to seasons and the number of guests. Undisclosed guests at time of reservation will result in immediate eviction with no refund and complete forfeiture of your security deposit. Guests disturbing the quiet of others will be evicted with no refunds due. Any items or objects moved, cleared or misplaced including but not limited to garage, indoors or outdoors areas not found at its original place on the property at time of departure will be charged a fee of a minimum of $1000 or more. Overflowing trash cans or garbage found in places other than trash city cans will also result in full forfeiture of your security deposit. Overload of laundry at your departure may put us in a bind for next renters checking in same day, therefore you are expected to wash and dry yourself any excess of sheets and towels used during your stay at the exeption of sheets for the exact number of beds in the rental home and 2 towels per bathroom. Failure to do so may result in additonal charges and/or full forfeiture of security deposit.  Large parties gathering and/or professional photo or film shoot are not allowed unless written approval from Homes for the Moment. Failure to respect these rules will result in immediate eviction with no refund and full forfeiture of the security deposit plus any monies resulting from costs and/or damages. Management and Owners shall not be responsible or liable for incidents, accidents, injuries to anyone and/or loss of money, jewelry and renters valuables of any kind. Your payment guaranty your reservation first come, first served, therefore no reservation is fully confirmed until full payment is received. However, if  for any reasons, Homes for the Moment discovers that the house you reserved and paid for is not rentable upon your arrival due to an act of God, unexpected last minute maintenance needed in the house and/or due to failure from home owner(s) not honoring your reservation based on Homes for the Moment criterias, we shall then, put our best efforts to relocate you in a different house of same caliber for the same price. Once we  have  offered you a relocation, your signed agreement related to your original reservation and the entire content of this disclaimer shall be in effect and no refund or compensation shall be due. Homes for the Moment, its employees, agents or representatives shall not be held responsible for any damages and/or liable for relocating you in a different home than your original reservation.  In the event we are unable to relocate you, we shall inform you and will refund you any monies you pre paid minus $100 administration fee. In this case, no damage and/or responsibilities and/or liability shall be held against Homes for the Moment,  its employees and/or any of its  representatives for not honoring your original reservation. This entire disclaimer including all terms and conditions within shall be part of our rental agreements and/or replace the absence of signature from Homes for the Moment.

18. Equal housing opportunity: All submissions are subject to the federal and California fair housing laws, which makes it illegal to indicate in any advertising “any preference limitation or discrimination because of race, color, religion, sex, physical or mental disability, familial status (e.g. “No children” or “not suitable for children”), sexual orientation, ancestry, marital status, or source of income.
